1. 9MBi.com is a online marketplace where non-affiliated independent third parties ("Merchants") provide 2D and 3D content to registered users.

2. Merchants must themselves register as members and submit content in accordance with our submission criteria.

3. User and Members agree not to use this site for any of the following:
  a. Any practices that affect the normal operations of other users and/or the hosting of this site (i.e. circulation of computer viruses).
  b. Transmitting any libelous, defamatory, or any other material that could give rise to any civil or criminal liability under the law.
  c. Personal attacks. This includes but is not limited to, destructive, abusive, defamatory communications in any form, and retaliatory attacks from personal attacks.
  d. Advertising or linking to any publications and/or web sites that are age restricted due to content, and/or pornographic in nature.
  e. Posting unacceptable images:
    i. No Rape
    ii. No Torture
    iii. No Sexual acts, lewd or illegal acts
    f. Any threats of physical harm, property damage or acts of violence toward another individual, or group of individuals.
    g. Fraudulent use of credit cards or refusing to pay for items received via this site
    h. Soliciting or trading of any products illegally. This includes, but is not limited to, requests and/or distribution of computer software, software security overrides and serial numbers.
    Members/Users found practicing these behaviors will immediately have their membership revoked, and access to the site permanently blocked.

    Notwithstanding the fact that member information is confidential, there may be certain situations that necessitate disclosure such as the legal proceedings arising from Users/Members improper use of this site as outlined above.

4. 9MBi.com provides a variety of communication services to members. These include: forums, galleries, chat rooms, message boards, instant messaging, and email. Any information provided by members using these services is considered public information. 9MBi.com will not be held responsible and/or liable for information that members choose to share via these services. We strongly recommend that members exercise forethought and caution prior to disclosing any personal information while using these services.

5. 9MBi.com maintains a database of member/user information to facilitate the 9MBi.com's operations for members, users and administrators. Please see our Privacy Policy for further information on how this information is collected, stored and processed, where your agreement to this User Agreement also means your agreement to the Privacy Policy

6. All licenses and other contracts regarding submission of content and its use are solely agreed by and between you and us in accordance with our standard terms. We may amend and vary these standard terms from time to time as may be reasonable and subject to giving you notice of the changes.

7. 9MBi.com cannot guarantee 9MBi.com availability at any specific time and assumes no liability for any actual or consequential losses or other damages arising from loss of availability. 9MBi.com does not guarantee availability of downloadable purchases after the first download or 30 days whichever comes first; however 9MBi.com will make a good faith effort to make downloads available indefinitely as a convenience to our customers. It is solely the responsibility of the purchaser to download and back up the purchased file within 30 days.

12. 9MBi.com may terminate your access to 9MBi.com site at any time without prior notice if you violate any of these Terms of Services.

All content offered via 9MBi.com is copyrighted and protected by intellectual property law and/or international treaty, where ownership is retained by Merchants or by 9MBi.com (where it provides its own content). 14. Should any provision of these General Terms of Service be invalid or unenforceable, the remaining terms shall remain in full force and effect.
